HOA Dues Don’t Transfer Automatically
In a subject-to transaction, the deed transfers but HOA dues must be explicitly addressed in the purchase agreement. We take responsibility for all HOA dues going forward from the date of closing. Any delinquent dues owed before closing are typically resolved at closing (either paid off or negotiated with the HOA).
HOA Transfer Fees and Requirements
Las Vegas area HOAs often require transfer fees, resale disclosures (the “resale package”), and sometimes an inspection before a property can transfer. We handle all of these as part of our normal closing process. This is not unique to subject-to โ it applies to any sale in an HOA community.
When HOA Delinquency Complicates Things
If you’re behind on HOA dues, you may have a lien on the property. HOA liens can complicate any title transfer. We work to resolve HOA liens at closing โ either paying them off or negotiating a settlement with the HOA. This is manageable in most cases.
